    Two years out...questions???

    Hi All,
    We have just two years left in our Chp 13. Everything has gone very smoothly, but I am starting to worry about the discharge process. We've completed & submitted our discharge education. We have a wonderful attorney but I hate to bother him with so many questions. Is there always an audit? If so what does do we need to know. We filed -September 16, 2009 not confirmed till Jan. 11th, 2010. Network 13 states "closing order date January 11th, 2015". What does that mean? I thought we would be done with this 5 years from the filing date?? Our mortgage too is paid through the plan so I was wondering how this all plays out?? Sorry if it seems that I am rambling but I have always been one that has to everything in order-even though we are 2 years away. Thanks in advance for any advice.

    Every Chap 13 is audited to make sure all the creditors have been paid as set forth in the plan. It is nothing for you to worry about.

    It sounds like 1/11/2015 is the estimated closing date. It is not the same date that you stop making payments. Network 13 is a tool used by the trustee to administer your case, not a record of the court. Your particular trustee probably uses that date as a tickler to make sure cases get closed on a timely basis. I wouldn't count on that date as a definitive close date.

    With two years left in your Chap 13, you really should not be worried about what will happen at the end. Other than making your plan payments, there is nothing you can do this early to make sure things go smoothly 2 years from now. Unless I have already received instructions from my trustee or attorney, my plan is to call my attorney after I send in my second to last payment and say "My last plan payment is next month. Is there anything that needs to be filed with the court to make sure I get my discharge as quickly as possible." If my mortgage were being paid through the plan, I would add "When should I start making my mortgage payment again?"
