I understand it will be difficult, and maybe not possible. The reason I'm worried about his credit is if we need to do a loan modification. We haven't looked into all our options yet. But I would think we would need to keep his credit score in good standing for that. I'm also hoping that the lawyer will look at at when my dh is done with his schooling, 2 more semesters to go he guranteed a job at the same company making almost double what he is now. It has taken a long time for him to finish his enginering degree, but it will be worth it when he is done. Maybe wells fargo will work with us, and I hope they do, we just need to get an idea of all our option.

I don't know if you're aware of this, however your credit report has nothing to do with getting a loan mod; its your LTV and debt to income ratio's that they look at.
Your lawyer isnt going to look to the future when considering your options unfortunately - he's going to be looking at how things are right now, today. You cant bank on "future promises"...its the here and now that is taken into account.
Have you sat down and gone through everything together - writing it all down (all debts, income, expenses, etc) and taking into account getting rid of what you need to? You need to get a very clear picture of total expenses as they stand today, adding in areas that you dont currently have (medical expenses, health insurance, etc) if you're even looking at a Ch. 13 or even mediation.
its an uphill battle, but there are resources out there to help you / your family in many areas, especially in healthcare. I have somewhere in my postings a post I did for those that need assistance in medical areas, if you search through, you will find it. I believe OP IS including her hub's income- I get the feeling she is not working. I also suspect the state covers the family's medical.
She also probably won't be able to rent for less than she pays, even if she manages to find some kind of Chapter 8 housing.
Plus when hubby gets the raise, all that assistance will probably disappear.
Talk about rocks and hard places.
OP, if you can squeak by for the year, maybe get the loan mod, perhaps you can avoid the bk. This has got to be mega stressful for you. Could you possibly do some baby sitting on the side to earn a couple bucks here and there? I am sure you are the queen of stretching a buck when it comes to buying clothes and other necessities for the kids, but just in case- you do have some thrift shops around and know about freecycle? Assistance should be available for utilities including water, and food banks. The Lions Club may help with the glasses. Perhaps you could build up a small cache of cash if you could make use of these resources.
