    So close to being done...questions!

    So, my 13datacenter status says "completed"! It did say "ready for completion audit" yesterday and today is "completed"! Love seeing it change! It also says "Date Cased Closed - 6/15/2012" Should I be celebrating just yet? That doesn't mean official discharge, right? Yesterday, I also received a copy of a letter sent to my lawyer by the trustees office telling her to file the "Certification of Issuance of Discharge".

    My 13datacenter says I have a balance of 974.00...there is only 524 left to pay of our 18%. We also get paid this week and I guess that garnishment will be added to the 974.00. Im assuming that all that extra money will just go to the creditors since I am not in a 100% payback plan, correct?

    Is there anything I should be doing on my end?

    Thanks so much! I can't wait to receive the official discharge paper from the courts!

    Your attorney needs to be on top of this. Hopefully you are now in contact with your attorney. There are things that the attorney needs to do to shutdown the Chapter 13. Since you have a Wage Deduction Order, make sure the attorney follows the proper procedures for your District to have the Wage Deduction Order Vacated! Otherwise, they could keep taking payroll deductions for weeks (months) before it's all sorted! (True story... not only have I had this problem with ending the Wage Deduction, another BKforum member has had this happening for months!) Don't let it happen to you!

    The other thing is the Motion for Entry of Discharge. I suppose they call this the "Certification of Issuance of Discharge". You must also certify that you have no outstanding DSOs (domestic support orders), and then the Court can grant the discharge.

    Stay on top of this. Some attorney offices "forget" about their clients since many clients have been in their Chapter 13s for as many as 5 years!

      We're in the same place! Just checked 13datacenter and it says "Completed-frp" in one block and "Closed" in another on 6/13/12. So I then went to Pacer and saw 4 new documents: 1) One saying that the Financial Course completion form B23 and certificate must be filed (already done that) and the Motion for Discharge must be submitted (will be calling my lawyer tommorrow about that), 2) one creditor sold my account with them on 5/31 (don't know why they did that this late in the game) to a 3rd party 3) the wage garnishment is to be cancelled 4) letter to all creditors to give them 30 days to object to the ch13 discharge and for all checks to be cleared and says the case was reviewed and all payments were made in accordance with the plan. So now after calling my lawyer to file the Motion for Discharge I think it's another 30 day waiting time and then shortly thereafter the Discharge will come.

      But while this is good...no...GREAT NEWS...it does open a whole other situation for us. Five months after we filed, my husband lost his job and we modified our ch13 to surrender our home. The Bank never filed to lift the automatic stay so foreclosure hasn't proceeded yet (2+ years later). We have rented a house near our old home but now all the drama with the foreclosure will heat up since the Bank will be free to communicate with us once we're discharged. But I'm ready to get it going and hopefully it will not drag on for years and years.

      As far as your payments go, any thing extra paid into the plan will be refunded to you after discharge. I just made an extra payment (and they received it too) and I will be refunded that amount too once this is all completed.

      Congrats and let us know when your final discharge comes in. I sure will because I want to see that hamster dancing thing to celebrate!

        you have to take that financial management class at the end but for me it wasnt over until i got those discharge papers in my hand. congrats on making it to the end you are almost home,it was about 3 months before i got my discharge papers.

          This is so cool! I recently read somewhere that fewer than 10% of Chapter 13s make it to discharge, so this accomplishment is really a very momentous occasion and something to be proud of. Many congratulations.

            So, I have not received discharge papers yet, BUT they already stopped garnishment AND they already sent a refund check! We did our financial management course about a year ago. The trustee already filed the certification of final payment and we already signed our debtors certification regarding issuance of discharge saying we did not commit any fraud. Those have already been filed per Pacer. My lawyer is shocked that this is going so fast...everything Ive read from people say it takes weeks or months for anything to happen! We have our first full paycheck and a refund to boot Happy weekend to us!
