In chapter 13 and owe taxes for 2010 and 2011

    Here's a thought. . . do not know if it will work. . . just send $$ to the IRS. Notate on the face of the check (in red) that the payment is to be applied to 2010 taxes (oldest year first). See what happens. Keep a copy of the check you send and get a copy of the canceled one when and if cashed. Document, document, document.

      You should include you IRS BK reference # too. Also there is an address in Philly that deals with them.
      11/23/'10-filed ch 13. 1/6/'11-341, confirmed. Below median. Plan completed 11/30/2015. DISSCHARGED 4/4/2016.JP

        I had the same thing happen to me; What happened was my attorney called me one afternoon in the summer of 2010 and said the IRS was possibly going to file a motion to dismiss my case because I owed back taxes; I guess after the local IRS office reviewed my case, they decided to file a "Tax Lien" against me for 2 years owed, 2008 and 2009; Like you, I called the IRS main number, and the IRS Bankruptcy department; Basically, the gist of it is, if you are in a Chapter 13 Bankruptcy, and you owe taxes outside the plan, all you can do is pay towards the taxes owed until the bankruptcy is over with; That's what my IRS BK specialist told me; I've been paying the Chapter 13 and taxes, and it's been the hardest thing to do in my entire life; I never have any money left over, but I'm almost at the end of the Chapter 13, and I've paid the 2 years I owed back as well; I will still owe taxes for 2 more years, 2010, and 2011; Once my Chapter 13 is over, I will be requesting an official installment agreement from the IRS; It also depends on what state you live in as well; Some states will allow an IRS repayment plan outside of the BK13; Good Luck to you on this situation; I feel your pain;

          I think I will do that, pay outside the BK, with a monthly payment and after BK is over, I can raise the amount I owe to the IRS to pay off..

          I was thinking if I could not complete the BK 13 and have to go to a 7, then will the IRS talk to me about an installment plan??

          Are there penalties that keep getting applied by the IRS when you owe back taxes? I know about the interest they charge, but do they also tack on penalties until paid off???

            Yeah, that's been pretty much the only option for myself, in regards to this matter; I thought I was the only one; Unfortunately they charge both penalties and interest, until the amount for that particular year(s) is paid off completely;

              I just received another letter from the IRS, that I now owe $350 and to pay in full immediately to avoid interest and penalties. At least the amount is going down I'll call my "assigned agent" next week, after she's back from vacation, to verify that I can keep on with my "informal plan."

                That's cool the amount is going down; I think, THINK, the trick to it all is, for folks like us that are in this position, is to keep in contact with the IRS periodically, and make a conscious effort to send in payments on a REGULAR basis; I think it shows them, that you are acting in good faith; My BK will be finished, timewise, on 10/3; I've already satisfied by Plan Base, so I'm just waiting for the end; I will be formally requesting an official agreement once the BK has been discharged;

                FOR ALL OF YOU GOVERNMENT WORKERS OUT THERE; THERE IS LEGISLATION THAT HAS PASSED THE HOUSE OF REPRESENTATIVES; THE ID FOR THE BILL IS HR 828; THE BILL BASICALLY WILL ALLOW THE GOVERNMENT TO FIRE WORKERS THAT ARE SERIOUSLY BEHIND ON THEIR TAXES; THE DETERMINING FACTOR IS A TAX LIEN THAT HAS BEEN OFFICIALLY RECORDED IN PUBLIC RECORDS; THE ONLY WAY YOU CAN BE EXEMPT IS TO BE IN AN OFFICIAL PAYMENT PLAN, OR THE FACT THAT YOU ARE FIGHTING THE PROPOSED LIEN; I'M A FEDERAL WORKER, AND I'VE BEEN WATCHING THIS BILL FOR 1 1/2 YEARS; IT PASSED THE HOUSE OF REPRESENTATIVES ON 7/31 AND NOW IT'S MOVING ONTO THE SENATE; PLEASE ASK YOUR SENATOR TO OPPOSE THIS BILL; THERE'S A LOT OF US OUT THERE THAT ARE STRUGGLING AND WE'RE TRYING TO MAKE GOOD, AND THIS PROPOSED LEGISLATION IS COMPLETELY RIDICULOUS; I AGREE EVERYONE SHOULD HAVE TO PAY, BUT THIS BILL DOESN'T EVEN TAKE CARE OF THE PROBLEM; THANKS ALL;
