    Mortgage payment going up due to escrow amount increase

    I received a "copy" of a letter that was sent to my bk attorney from Chase stating that effective 3/1/2012 my monthly mortgage payment would be increasing by $16. My mortgage payment is being made through my bk. I looked at the National Data Center site to see what amount was disbursed to Chase for March, April, and May and it looks as if the trustee is still sending in the old payment amount. I have called several times and left messages with my attorney along with his paralegal but no one seems to call me back. I am beginning to wonder if the trustee's office even received a copy of the letter. Should I try to contact the trustee directly since my attorney will not get back with me?

    The trustee will not speak with you directly because you are represented by counsel. If you try to contact him or his office, you will be advised to contact your attorney. If no one is returning your calls from your attorney's office, go there in person with a copy of the letter and ask what is being done as to this increase. Since your mortgage payment is being made out of your plan, your attorney has to be involved. If you were making the payment on your own, you would just send in the additional amount as any bills incurred after the date of filing are your own responsibility.

      I dont think it would hurt to try and talk to the trustee. The worst that could happen is they will tell you to contact your attorney. It sounds like your trustee may not have been informed of increase. I was also given an increase of $20 a few months ago. But in my case I got separate letters from Chase and from my trustee informing me of the change. And I got those letters about 3 months in advance. So I'd say there is a lack of communication from someone regarding your case.
