    I guess I'm not sure why I didn't know about the hearing that took place on April 9th. Maybe I could have shown up and fought a little harder for the plan modification. I'm not sure what really took place besides getting an extension on the automatic stay. All my lawyer says is that we need to make a deal with USDA asap. All I can do is offer higher payments in the plan. My question is since the arrears are outside of the plan can I offer higher post petition payments or is it better to pay more inside the plan? Thanks

      Outside the plan, directly to the lender is cheaper - no additional trustee fees and faster to accomplish. A typical settlement in my district is

      1. Resumption of regular monthly payments.
      2. The submission of an additional $xxx per month for a total of 6 months to “cure” the post petition default.
      3. Should debtor fail to pay 1 or 2 above, creditor sends a 15 day notice of default.
      4. If the default is not cured within the 15 days the creditor is free to foreclose.
