Great, I found the document. However, in my initial BK13 my 2007 vehicle from Santanter Consumer USA was planned as paying Outside the plan. However they were listed on the Trustee's 13datacenter and have filed a claim on the Pacer register also. Does this mean that they are a part of the BK 13 plan ? I am now confused as I just mailed them a payment a few days ago and they have not responed with the normal replied e-mail that payment was received thankyou ect::::.

All of your debts are included in your plan, whether you pay them directly or they get paid from your plan payment. Anybody who you owe money to should file a claim and it will show up in PACER as does everything that gets filed with the court. Don't rely on 13datacenter for anything, except maybe to confirm the trustee received your payment.
If your attorney told you to make the car payment directly to Santanter, that's what you should do. Communications from Santanter may not be the same as they were before you filed. Call them if you want to confirm they received your payment. If you have any doubts that you should make the car payment directly, call your attorney. You can also look at your plan to see how it treats the car payment.LadyInTheRed is in the black!

I made my first trustee payment on the 6th of June via certified cashiers check and it has been recorded on 13data. I had given my Attorneys office the required information for payroll deductions by-weekly I.E. contact name /number /address ect. Today I received a letted from the Trustees office with information to start my payroll deductions effective on the next pay period . Will my employer receive the same statement letter or do I have to go to payroll to get this started? My payments are due on the 6th of each month and as I have listed I have already paid for June and do not have a payment due until 7/6/12 which is three pay periods away, I just am wondering if I they start my payroll deductions this week I will have made two initial payments in June.

You do not need to do anything to tell your employer to make the deductions. They will receive the order telling them when to start.LadyInTheRed is in the black!

Oh, they did receive the deduction requirements and effective this weeks payroll have taken out the required amount to be sent to the trustee's office. Seems as though I have already made the June payment , but now I am being deducted for payments in June which will have me making two payments this month in which was not in my required budget for June , what a way to start a BK13 ?

You should ask your attorney about this. But, my guess on what is going on: You made your June payment. You have another payment due July 6th. So, deductions need to start with your next check so that there is enough to make your payment by July 6th. My district doesn't require wage garnishment, so I can only guess at what is going on.LadyInTheRed is in the black!

I do think your are correct, this was not a wage garnisment, however it was a request option on my part to have payroll deductions to ensure proper payment receipts and to eliminate me from having to mail or having them have access to my checking account ect.... I did call the Trustee's office and they said they would review the situation to see if I am to receive a refund because of the 2 payments in June " since my employer was so fast in starting the deductions" . But I am more inclined to see forward as your reply notes to the July payment and to let it go and move forward from this point. thanks for your input.

Had 341 meeting today, Trustee ask the required questions and "to the advice of the forum " I answered in yes or no responses which was great. He did ask how my son's 2005 Mustang was bought and I had to answer that , however he had no objections today on my petetion other than a motion to file If more claims $ was filed on me that he would increase the monthly payment. But I know that I listed all and even a couple that I paid off that will not file a claim. He said with that motion I would get confirmed . How long before do you think I will be notified if I am confirmed or not?

Had 341 meeting on 6/27/12 All seemed to go well with no issues. Basic questions ect... Any guess on how long it will take to get confirmed in the state of Illinois ? In addition will the plan begin at time of petetion or at time of confirmation? I have been making payments for a couple of months now.
