If you can wait until 4 years after your prior ch. 7, then you'd be eligible for a discharge in a 13. If you file sooner, you'd have to pay off all your debts in full in the plan. You don't seem to have DMI sufficient to fund a plan where you'd pay everything in full.

It would perhaps be feasible to file once you're past the 4 year mark - and pretty much convert your car payments into a plan payment. Something to discuss in depth with an attorney, of course.

We are about 8 months into a 60-month loan on two cars, combined owing about 26k, both 2009s and in good shape. Looking at approx $17k in unsecured debt combined.

Will meet with atty on Mar 6...even tho November is a long ways off and there will probably be garnishments starting before then, since I can only do one garnishment at a time, I could probably ride it out until November..

Congrats on getting the appointment so you can be on your way.

November is a ways off but you know where to come for a sympathetic ear and honest, well-meaning advice!!

Quick update: Meeting went well, hoping to file by end of May... Retainer fee paid, remainder of fees to be paid by end of May...changed one of our cell numbers and we are answering the PDL collection calls on the other and referring them to our attorney...The online PDLs are refusing to give a physical mailing address, so thats a good sing, right?... I have a small claims case pending for $900 but I never received proper paperwork on it, so I am denying the claim to buy me a little bit more time.. Found a cheap dependable truck for $1000 that I can use for work, so we are going to surrender one of our cars to Americredit...uggh...these guys are nasty.... Will fold other car loan into our CH 13...atty said we had our ducks lined up already, and our monthly Trustee payment should be between $400-$500... Looking good so far...
