    Discharge question.........

    Well I should be pretty happy right now. Just got discharge notice in mail!!
    But..... I have a little nagging question in the back of my mind. So, even
    though I was divorced a good year before I filed my chp 13, now after my
    3 yr plan is complete and I am discharged, is it possible that creditors
    would attempt to collect from my ex? I hope that this does not happen,
    as it would be another huge headache I do not need!! Has anyone ever
    heard of that happening???

    Well, it is possible that collectors could try to collect from your ex weather they have a valid claim against him/her or not. If you and your ex had joint debt, the creditors have a claim against your ex. If there was no joint debt, they don't. If they try to collect on your separate debt, your ex should tell them it's not his/her debt. I have yet to hear of a creditor going after a spouse for the other spouse's discharged separate debt. But, that doesn't mean it hasn't happened.

          How long did you wait on your discharge after your 13 closed? Mine closed in January and I am patiently waiting on the discharge paperwork.

            Now about whether your ex can now be approached by creditors or not. Did your ex file with you? If yes, what happened with your case after the divorce? Was your plan amended?

            To make matters even more complicated, Wisconsin is a community property state which means that both spouses are responsible for debts that were incurred during the marriage.

            We need more information before we can help you sort out what might happen to your ex in this situation.
