Tax return question

Hello All,

Filed my CH-13 in AZ last Jan 2011, and have tax return question. We are not in a 100% payment plan, and my Fed and state refund willbe about $5k. With 3 kids and desperate need of auto and house repairs ( kids have medical expenses as well), has anyone negotiated (with the trustee) to keep part or in whole, their tax refunds? If I cannot use part of most of this refund, we are screwed, simply put. Expenses have changed since my filing last year, everything has gone up and car and home repairs are in need badly. What are my options?

Is your Plan Confirmed? If so, what does the Order Confirming state? If it only requires that you send copies of the tax returns and makes no reference to the turnover of refunds then you keep them. If it requires the turnover of the refunds you will have to contact your trustee (through your attny if represented) to negotiate something. I have done this with my clients and so long as the amount of the refund is added to the Plan in some way, have not had any problems.

If your Plan has not been Confirmed you need to find out if the Trustee even wants the refunds.
