    justbroke, I'm not sure about a confirmed plan. I have what the lawyer filed and the trustee accepted, which included the secured loan. I have a plan base of $9000. There were no specifics on how the car loan would be paid back. I did notice that my percentage paid to unsecured creditors was higher than my lawyer told me it would be on 13datacenter (I just signed up 6 months ago) and I'm assuming that is because the car title company did not file a claim as we expected. I understood NOTHING about bankruptcy when I filed and everything I've learned, I learned from this site and internet research. Even the concept of "filing a claim" - you guys taught me. When I called the lawyer's office and explained my question about my car title, the paralegal said "Oh, you know what your talking about. You said they didn't file a claim". This gives me the impression that they prefer their clients in the dark (IMHO). Anyhoo, my lawyer is contracted to stay with me throughout the bankruptcy and to negotiate with secured creditors. And she may be willing and very helpful to me when I am able to speak with her.

    tobee43, no worries! It's a valid question. I had a car accident with no insurance in 2001 and filed Ch 7 in 2002 to stop wage garnishment. I've learned that I can't convert because the filing date will still be counted as 2008, which is too soon to file another Ch 7.

    And just to create a clearer picture. I am (and have been) without parents, grandparents, and other family. Its just me and the kids. I'm the second in my family to get an undergraduate degree and the first with a master's. No matter what happens, I have to make sure the children eat and nobody around me is in ANY position to help me. I can't be without a car for more than weekend before it will become a full blown crisis in my life. Don't get me wrong, we are fine. We are blessed, maintaining, and happy. But this little $4000 minivan is very important in my world.

      Spoke to the lawyer's office. The creditor may have a time limit to file a claim but we (debtor, lawyer, trustee) do not. They told me that I can still file a claim and make the car title loan place participate in plan. If I do that then I will get my title back at the end of my plan. So........yayyyy! Crisis averted. Panic diminished.
