    Trustees - budget objections

    Hi ,

    i am wondering what things in your budget the trustees will likely contest - i realize theres the irs standard and then there is the actual expenses that you incur , can you budget for holiday gifts - house reapirs - suppose the roof starts to leak - what about ot of pocket dental , i need to crowns 3000.00 hgow am i supposed to get the trustee to alot for that ???? -

    any help is much appreciated

      You ened to learn how to save money based on the exemptions that you do get! If you're allowed $1,350 for 4 people for food and clothing per month, then don't spend $1,350 per month on that... try to spend $1,000 or less. That way you are "saving" money for the emergencies.

      Out of pocket charges are actually already a category that's included in a standard Chapter 13 plan and is already listed as a line item on the Means Test. I think it's about $56/per dependent per month. IF you are expecting a serious medical bill due to dental work, perhaps you can ask the Trustee for part of your annual tax refund? (This does depend on whether tax refunds are taken in your State.)

      The Chapter 13 plan is not about "speculation" on what might happen. It's based on what is the debtor's current expenses and income... with a slight lean towards the future. You can't ask for things in anticipation of them happening -- in most cases.

      You need to attack it as a BUDGETING problem! A person who only makes $12K a year with $12K in expenses a year, has a budgeting problem (in most cases). They need to save so that they only have $11K (or less) in annual expenses so that they can build a $1K/year savings.

      A Chapter 13 Plan will never work for someone for is unable to or refuses to budget. If you work with a great attorney, you should be able to save money throughout the life of the Chapter 13 Plan.
