    Overtime

    My 341 is scheduled for 12/21. I am to bring my most recent paystub which will have 7 hours of OT on it. My DMI is very low so I'm a little nervous the trustee might question it. There is some ability to work OT through January but other than that OT is strictly prohibited. I thought about not working it but it will be nice to have a couple of extra bucks for xmas. Do I have anything to worry about?

    Also, I am supposed to mail in my payment to the trustee by 12/17 and every month on that date thereafter. Since I'm not allowed to use a check or debit card and have to do a money order do I need to send the payments certified mail return receipt requested to make sure they received the payment? The last thing I need is for a money order to get lost in the mail and not get there. What was your method of payment to the trustee?

    When we started we mailed a money order from our bank. Always made it there. Now however we found out that our trustee accepts direct pay from bank so we have setup automatic payment each month to our trustee.

    Can't provide any insight on the OT. They look back 6 months so I don't see how 7 hours OT can do much damage in terms of DMI. Not sure though. Others on here will have to chime in.

      When I filed, I had to provide two months' worth of paystubs. If you show 7 hrs OT every week, you'll likely have questions coming your way. If you get it once in a blue, not likely.

      Money order sent USPS Priority with delivery confirmation has worked well for me. YMMV.

        Oh, I did have to provide those for filing but just the most recent one for the 341 meeting.

          I am 13/48 payments into my chap 13. Money orders are required with my trustee and sending them USPS First Class Mail, with a Certificate of Mailing has worked out rather well. This costs $1.59.

          I also send the payment about 10 days to 2 weeks before the due date. I don't use Certified Mail with the green card for this, since it would probably slow things down.

            Our Trustee took checks. We sent up payroll deduction, but until that was done, we mailed a check. We pay bi-weekly, not monthly.

              Your trustee should have instructed you as to how to send payment and in what form. We had to send a cashier's check which I sent priority mail each month. The expense of a return receipt is not necessary unless you feel you need it. Just keep copies of all paperwork for however you send your payment.

                Yes, I do know how to send the payment in. Was just wondering what people were doing to ensure the payment was received.

                  Assuming your trustee uses this service, as most do, you can pull up all the details about your case including payments received, payments disbursed &c.
                  Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

                    Thank you. Signed up and my case is on there. Nice to know there is somewhere I can go to make sure they received my payment. One question. It says that I will owe $100 monthly next to payroll deduction amt and not direct pay. Do some trustees only take payroll deductions? There is no way I want to have a payroll deduction as I don't want my employer to find out about my BK. I am supposed to mail in my first payment by 12/17.

                      That's really dependent on the area and the Trustee...if I had that concern, I'd bring it up to the Trustee at the 341 meeting.

                        Yes, in lots of areas, including my district, wage withholding orders are mandatory unless the debtor is self-employed or has only Social Security income. Otherwise, to get a self-pay plan confirmed requires a motion and a hearing. I used to file motions where people wanted to self-pay because they didn't want their employer to find out. Over the years, I've come to realize that Chapter 13 plans are FAR more likely to be successful with withholding orders and that employers, in 99% of the cases, couldn't care less if their employee files for bk. So the time filing the motion and going to the hearing is better spent persuading the client that their employer doesn't care and to get them on a wage order.

                          Trust me, I work for a religious organization and they are gonna care. Do I need to contact my attorney then before the 341 to get this changed or do I bring it up at the 341 meeting?

                            Look at your plan. It should specify on there somewhere how the payments are set up to be made. If it says "self pay" or such like, you're ok. If it says "Wage Order To: Mountanddo's Employer", a wage order has probably already gone out. So I would suggest you talk to your attorney depending on what the plan says. By the time you get to the ยง341, the wage order will already have been sent if that's the way the plan is set up.
