    Convert a joint chapter 13 to an individual

    I live in southern California and am in a joint Chp. 13. How do I remove my ex husband from it and just make it individual? My husband is no longer paying. Get his wages garnished from the divorce settlement will take months. I can't lose this case because it is mainly IRS debt. My name is on everything. I want it just in my name so the case is not dismissed.

    You need to contact your lawyer right away to let him know about your ex's non-payment. That way he/she can re-evaluate your Ch 13 case to see if splitting it apart will still deal effectively with your IRS debt. Get going and good luck!
