    Putting money into prepaid tuition plan after ch.13 confirmation

    My Ch.13 was confirmed and I have already made 6 payments. My attorney asked me not to put money into Florida prepaid tuition plan (for my son) before ch.13 confirmation from the date of filing. My wife is not in Ch. 13 bankruptcy. Now, my wife gets some extra money from her relatives and friends. She wants to put this money into prepaid tuition plan. My only question is: Will trustee anytime look into prepaid tuition plan during Ch.13 or just before discharge? I always heard that trustee asks for tax refund and not even bank statement. Is it true?

    Is this a 529 savings plan?
    10/27/11 - Filed Ch13 ------ 2/27/12 - Conversion to Non-Consumer Ch7 ----6/11/12 - Discharged!

      No. It's just Florida prepaid college tuition plan. There is no tax benefits or IRS reporting with this.

          Hi - I don't see why that should be a problem..you're not incurring debt, you're simply saving money in a specific kind of savings account...

            I don't think it will be a problem, especially if the source of funds is gifts from relatives of a non-filing spouse, hardly any grounds to object.
