I stopped paying my CC last August due to some medical problems and as a result I lost my job. In the meantime I have been working temp jobs but have basically been living off of skeletal funds as I was unemployed between jobs for a few weeks at a time and have had to play "catch up" each time.
I received a summons on August 27th that stated I had 20 days to respond, though now that I look at the summons tonight there is no date anywhere on the summons as to when it was given to me. I was served at my apartment. I met with an attorney the next Saturday for a free consultation and we determined that it would be best to file C-13 as the only other option would be for them to get a judgement and garnish my wages 25%. This is only one of 4 CC.
Basically I have nothing. I took the $900 out of my savings and closed my account and used some of that for the filing fee. The rest of the attorney fees will be rolled into my C-13. I have about $400 left.
I am getting nervous now because the attorney told me that they could take money from my account 45 days after they serve me the summons unless I file.
I need one more piece of information before I can file. A copy of my 2010 state taxes. I sent the form with a money order a few weeks ago and have not received it. Phone calls to find out if it has been mailed have proven unsucessful just that I should receive it soon.
It says that I must repspond to the summons within 20 days, which has passed, even though it may not be filed with the court and that there may be no court file number on the summons. I choose, with the advice of my attorney, not to respond as the filing fee is $320 and there really is no reason to dispute as I owe the money.
Do they have to send me another summons when they actually file this in court or can they get a default judgement from the summons that they served me on August 27th. I did not sign anything, he just handed it to me and left. I'm confused as to why there is no date on it or why it states it may not be filed with the court yet.
Should I take my money out of my checking account. (I only have enough in there to pay rent) and cancel my direct deposit?
I also don't want to get a judgement before I've had a chance to file as I've heard they are hard to dismiss and as I live paycheck to paycheck if they take any money I could end up geting evicted if I can't pay my rent and I have NO options to borrow money from anyone.
I know from reading a lot of posts that a lot of people here arent' "broke" but are insolvent. Unfortunately I AM broke. I just don't want to get blindsided and am started to freak out a bit.
For those that wonder, I can't file C-7 as I filed 7 years ago due to a business closing and a divorce.
Any advice, hand holding or pep talks are welcome!
