    Less than a year to go and have questions...

    What a few years its been! We are still plugging along (18% payback in a 36 month plan).

    Several questions:

    First, when I look on the datacenter site for my plan, I can see that the trustee pays every unsecured debt monthly except for ONE. Not a single thing has been paid on it. Should I be concerned or just wait to see how it plays out in the end. I can see the "principal owed" on it. When I add that with the rest of the "principals owed" and divide it by how many months I have left, it does equal to my monthly payments. Maybe they are waiting to pay them in one lump sum? I see that particular debt still shows up on our credit report as an active revolving credit account that has not been paid.

    Second, I see an unsecured debt that did not file a claim...it was a cc with a balance of almost $8000. No claim listed and no "principal owed" listed...just listed under "scheduled". Is that common? Does that mean they don't get anything? Can they still try to collect after the bk is discharged?

    Third, my spouse is the beneficiary of his mothers life insurance policy. Its not for much...$10000. She is terminally ill with cancer. If she should happen to pass before our bk13 is up, can they take that? Not that we were going to go spend it on us..it would mostly go to her arrangements, but I didn't want them to take it.

    Fourth, when our 3 years is up, do they automatically stop the garnishments or do we have to tell them to do it? Do payments still come out until its officially discharged?

    A Chapter 13 payment plan is for a specific number of months, and each payment is for a specific amount. Once you have paid all the payments in the amount stipulated, you have completed the plan. If there are no objections from any of your creditors (and there shouldn't be if things were done properly), then all of the debts that were listed in your filing, and that are dischargeable (some are not) - will be discharged, regardless of whether or not the creditor filed a claim. The trustee distributes amounts to creditors as appropriate - the debtor has no responsibilities in this matter.
    Your wage attachment will stop when the trustee gives to notice to your employer. You will receive any overpayment back from the trustee if the timing is off.
