    HELP! Urgent!

    3rd year in my chapter 13..

    A company which claims I didn't remit a balance in 2009 filed negative comments on all three of my credit bureaus. I called them to explain that I filed for CH13 prior to their negative credit bureau comments, but I spoke to a phone rep, which said that she can't help me.

    Do I have any recourse?

    I guess you dispute the negatives with the credit bureaus. Keep hounding them (credit bureaus) by writing letters upon letters until they get tired of you and wipe off the negatives.
    Filed August 20 341 on September 23 Report of No Distribution - September 24 Case Discharged and Closed on November 23!!!

      Also if you have a lawyer alert him or your Trustee for sure. You may be able to get the Court to give them a bit of a sanction. 'Hub

        Definitely speak with your attorney if you have one. There could be issues in a Chapter 13 if this creditor was not notified of the case. If you didn't include them on the schedules and your case is paying a dividend to unsecured creditors, it may be a little tricky to get this straightened out.

        Even after what I post here, try disputing the entries with the credit bureaus. That may be the most expedient way to fix the issue.

          Are there sample forms / letters I can follow to obtain the best results (when addressing the credit bureaus).

              Past due amount / collections. They claim these collections are prior to my ch13 filing, but I never received anything until now. Isn't there an "order of stay" if you're in ch13?
