    Possibly relocating mid plan

    We are in the very early stages of preparing to move out of California. We are two years into a 5 year plan. The only reason we went with a CH13 instead of a 7 was to strip the second on our house. Obviously we would have to modify to walk away from the house, also there would be a significant drop in income and expenses if we actually moved. The real problem in my mind is that we won't have hard figures until right before we move which makes planning pretty difficult.

    How hard is it to relocate to another state, new employer, new housing while in an active 13? We have a small window in which to do this because our children are just starting school and would like to move before it becomes way to difficult to adapt to a new place with a different lifestyle. We would like to move in less than 2 years, probably much sooner. If my wife were to quit her job in preparation for a move, would we be able to use the change in income to convert to a 7? The preference would be to convert to a 7 and start with a clean slate in our new home state. Any ideas or experience? I would like to have info and a solid outline for a plan before I turn on the "lawyer meter".

    It would be difficult to try and modify your plan until you know what your new housing payment will be, and all other expenses that could change when you move. Much much easier to try and convert to a Chapter 7 now and relocate after that discharge. Since you stated you were in a 13 only to strip your 2nd mortgage, does that mean you were able to qualify for a Chapter 7 when you filed?

    I'm not sure how your trustee would view your wife quitting her job, but with young children at home that could be something they wouldn't object to.

      We could have gotten thru a CH7 (and I wished I had) based on legitimate/allowable expenses but we understated some of them in order to fund a CH13 so we could strip our 2nd. I don't know how close we would be 2 years down the line.
