    Chapter 13 refiling

    Hello,
    I am refiling a Chapter 13 after being dismissed more than 180 days ago. I filed barebones initially followed by the requisite schedules on time.
    Is there any reason why a refiler is not allowed to file barebones again?

      I don't see any reason you can't file a bare bones petition again, but why would you want to? You've already had one case dismissed, isn't this the time to put your "best foot forward" so to speak? Again, I've done some reading and there doesn't seem to be any prohibition to filing a 2nd bare bones case, but you may will to check with your attorney to make sure.

        Thanks for reply Newbie2.
        This is a strategical filing having to do with preforeclosures so my objectives may be slightly different than others.
        On that note, my income listed for 2010 year to date in my filing last year was higher than the year actually closed out at. This will show up if there is comparison in financials from last year. Any advice as to how to prepare for this or am I giving too much weight to previous filing schedules as they may be inconsequential for the filing at hand?
