    Plan finally confirmed!

    Well folks,

    After 5 1/2 months, our plan is finally confirmed. My husband had two large overtime checks in our 6 month lookback which would have made our plan payment over $2100 which we definitely could not afford because those overtime checks were not normal. Our attorney argued the Lanning case and it worked! We ended up having to provide a years worth of check stubs to prove that those were the only two checks that had overtime, but that was fine. Our plan is $1500 for four years, then it increases to $2000 for 1 year after my car is paid off.

    I would have known nothing about suggesting Lanning to my attorney if it had not been for this forum. At one point our attorney suggested dismissing and re-filing so that the overtime doesn't appear but I'm so glad we did not have to go that route.

    So far things have been great. We are living within our means, using cash only and starting to save. Hopefully we'll have smooth sailing for the next 4 1/2 years!
    Filed Chapter 13 with lien strip on 2-28-11 * 341 held on 3-30-11 * First confirmation hearing held 4-20-11, continued until 5-25-11, continued until 6-29-11, continued until 8-10-11. Plan finally confirmed on 8-10-11!!!

      Congratulations, Lolly!

      It's good to hear of a case where Lanning was successfully applied. You should charge your attorney for providing him continuing education!
