    Question on income

    Hi all,

    After all long battle we have finally been confirmed with a huge monthly payment. It is a 60 month plan paying 39% to unsecured creditors. Our disposable income was based on my husband's income only, as I am not working.

    Here's my question: Any additional income, such as, I get a job, lottery winnings, inheritance etc. would go to unsecured creditors correct?

    You would need to let your attorney know, each district is different on how much they want, but yes the trustee would probably want the increase or a portion for the unsecured.

      Keep in mind that if you take another job, that job will have expenses related to it compared to staying at home. Eating away from home during the workday, new clothes, child care, etc - all of these chip away at whatever dollars you will take home.

      Do let your lawyer know if you decide to pursue a job, but keep in mind that depending on how much the new job increases your *disposable* income and your trustee's usual reaction in this situation with their Ch 13 cases, your trustee may or may not care about you joining the ranks of the employed. Your lawyer can advise you about what to expect with your trustee.
