    How about a check for mortgage?

    Just filed, made my first plan payment via money order, however the attorney (not very good I might add) is saying to pay the mortgage via money order also until the final meeting which is not until NEXT YEAR. I dont see why cannot just make a check payment to BofA and certify mail it.

    Thoughts?

    That is odd...I mail my mort payment with a check (which clears overnight...) or call them to make a phone payment (no fee)...

      I paid my first mortgage post filing Chap 13 with a personal check to BOA with no problems. BOA customer service rep said I could pay over the phone, but I want to be able to pull up and print all cleared checks to them for proof of payment in case any issues arise. My sucky lawyer suggests to all his clients that they bring in their first mortgage payment to his office for them to mail. Yeah right, they can't even manage to keep up with documents pertaining to our BK case! (Sorry, went on a little tangent there). : )

        No worries about tangents! That makes no sense - that they could mail it? A bit control-freak-ish...

          Needless to say, I mailed in my first payment and will be mailing in ALL payments myself.

              My mortgage company plays every trick in the book. They post that they got the check after the due date so it appears to be late. They wait about a week to cash it pobably hoping the check will bounce. They add extra charges, and any extra paid in gets manipulated thru their accounting system so they end up getting most of the extra money.

              What I do is send the check by certified check. I photocopy the coupon which list where extra money is suppose to go and then I photocopy the check which also lists where the extra money is suppose to go.

              As for shortages due to their creative accounting - I take them to small claims court and win because I maintain good records.

                Thanks for the replies. My attorney is already horrible enough and has even lied to cover up things we discussed and did not purse once he filed-he forgot, and his support staff is even worse. I will send a check certified.

                  When I filed 13 I lost access to making online payments and pay by phone. I mailed the payment to coupon to the bank in NJ. After a month I called because the check had not cleared, they had forwarded the check to the Mortgage Company's office in Illinois that deals with the mortgages that are was part of a bankruptcy. It took 2 months for the payment to post. After that I mailed the payments to the Illinois address as usual with no problems. The last couple of years I have been using bill pay from my checking account. It takes 5 days to post but I know they got the money, its a whole lot more peaceful than dealing with the mortgage company bozos.

                    I still have access to my online mortgage account with Chase. I pay it electronically through my bank. Never had an issue.

                      BofA locked me out of online access.
                      Then they charged me $25.00 on my rarely used checking account because it was not 'married' to a mortgage account, even though it was. Lady told me she would give me a 'courtesy' refund on the $25.00 and now the accounts are married again. Gee, feeling a little bit of nastiness on their part.

                        BofA cut off our online access, we never used it anyway. We pay everything electronically through our checking account.

                          We have been using our own banks online feature to pay the mortgage. No issues so far.
                          I don't think it is in the mortgage holders interest to delay noting the reciept of payment as even snail mail is part of normal business. There have been many rullings against collection agencies and creditors who have attempted to use the tactic.

                          Then again its easy for me to say as I have not had any issues like this with my mortgage, creditors yes.

                            I have caught Wells Fargo 3 times in the past 2 years trying to apply my payment to principle only and not actually applying to the current months payment. Keep in mind this did not happen the 10 years prior to me filing BK.
                            Why? not sure... but it sure does seem fishy.
