    CANDICA L.L.C. C O WEINSTEIN AND RILEY, PS & when does atty look at claims...

    Hi guys - well, I'm back with with a Candical Weinstein question - in 13, spouse's barkley's sold card to them; so did Cap One!

    But the claim they put in has like no proof - just cap one this amount, that's it. Is that enough for a claim??

    Also, in general, when does one's atty in general look at claims presented...??

    A creditor or collector can claim whatever amount their records show they are owed on filing day. If you disagree you owe this creditor or collector this money, work with your lawyer to dispute it. If the amount claimed is significantly different than what you think you owed on filing day, work with your lawyer to dispute this too.

    What kind of "proof" were you expecting to see for your creditors/collectors who filed claims?

    Also, in general, when does one's atty in general look at claims presented...??
    One's attorney can look at claims presented when ever he/she wants to check on them. However, in reality most probably won't look until the day or so after the last claims day is past. Nothing before that really matters.

    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Candica LLC = big JDB
      Barclay's = big UK bank, bought US credit card portfolio from Juniper bank in 2003
      Yes, it is enough for them to simply state a balance, often they include an affidavit from someone citing "business records"
      You can object if the balance is way out of line.
      filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

          THANK YOU!! Catleg...well actually the balance is correct in the sense that this is the same balance on which Barclay's offered a 50% settlement about a month before filing....

          Interesting about Candica/Weinstein - I couldn't even find a website for them...from their filings they're in Seattle.
