    That's one that I would push to the judge for a resolution. The judge is the final word, not the trustee.
    filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

      If it does happen that way remember that the whole 6% reduction now becomes taxable so you need to increase your tax hit.

        It did happen that way. I was just trying to get confirmed at the time and, if that helped it get through, I was willing to change it. And yes it did have negative ramifications during tax seasons along with the 6 months of no first and second mortgage interest to deduct. We owed both State and Federal where the year before we got a decent return.

        After being 3 months behind on the first mortgage, they would no longer accept payments even though I tried about a dozen times to get them to take a double payment. Filing a for a Chapt. 13 at the time stopped the foreclosure and allowed us to start making payments to them again. But that whole process took about six months from the last payment.

        Filed at the end of August 2010 and got confirmed in November 2010.
