    Discharge date?

    This is my first post to the forum. I live in Ohio and would like to know if the discharge date begins with the date of initial filing. Thank you in advance for your replies.

    Discharge is scheduled for 60 days after your first scheduled 341. Welcome to the forum!

      No. The discharge date occurs after you complete your 36-60 month plan.

      The filing of your petition results in an "order for relief". The "relief" you receive is in the form of an automatic stay that prevents your creditors from taking action to collect debts.

        True for a Chapter 7, but this post is in the Chap 13 forum.

            In every state but Michigan, your discharge date after your 36-60 month plan is completed successfully is tied to your filing date.

            Keep in mind that in Ch 13, your trustee will conduct an audit of your case that will tack several months (sometimes up to six months or more depending on how big the trustee's caseload is) after your last payment is made before your case is officially discharged by the bk court.

            08/10/11 - DISCHARGED !
