    Tax Claim Question

    Hello,
    I live in Maryland and filed a Chapter 13 that was based on a tax matter. I recently founded out that the state of Maryland never put a claim in. They were notified of my bankruptcy and even have it in their records when I file taxes because they have been sending me refunds. The issue is I have one year left on my bankruptcy. I read somewhere where if a claim is not put in then there is nothing that can be done however I think it may be different for the government agencies. Can anyone give me some advice on what to do at this point? Thank you in advance.

    It will depend on if the underlying debt is dischargeable?

    If yes, no problem, debt is simply discharged.

    If no, the debt survives (unfortunately). It may be a little late in the game to amend, but get in touch with your attorney and review options.

      When you say "underlying debt is dischargeable" please explain. I did contact my lawyer and he said to see if I could work something out with them directly because he did not think at this point it could be added

        Well, some taxes are discharegable and some aren't. My guess is, if your attorney is telling you to work something out, the taxes are not dischargeable.

          Maybe your tax matter only affected Federal taxes?
          Cause I'm sure they wouldn't be cheerfully sending you state tax refunds if you owed them and they knew it.
          They would have filed a claim or sent you a notice.
          Might be best to let sleeping dogs lie, if 2-3 years has passed already.
          filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!
