    Payroll deduction question

    Hi all,

    Some of you might remember me from last month. I was the guy who was upset about wage garnishment. The trustee never told me that they were going to do that to us, and it made me pretty angry. With help from some of the awesome people on this board, I got over it and accepted that I had no control anyway, so might as well just live with it.

    So, my wife got her paycheck on the first, we were expecting that the bk payment would be deducted like it was last month, but NO! Her check was for the full amount!

    So i called the apes in the trustee's office today to inquire why, and they told me that they had no idea that it had happened, and no matter what, we are liable for this month's payment (Expected). They suggested I contact the payroll department to investigate. My wife is a teacher at a public school. Outside of teachers, most people in the district could be considered legally retarded (which is why they get jobs in the school district to begin with)

    Me solving this problem is another full-time job in itself. I'm not going to spend any of my time cleaning up a mess between two parties that are equally inept.

    So my question is, does anyone know what the impact is if I just make the payments myself each month (like we were doing before), and let the trustee work things out with the school district? And isn't the school district liable for violating a court order?

    As always, all of your thoughts/comments are most appreciated.

    It probably just missed the cutoff date. I dont think they deliberately violated it. Its typical that it takes a pay period or 2 for it to happen. But most importantly, you are still liable and should send it in till it starts deducting.

      Our payments are taken directly from my husband's check every two weeks. We filed on 2/24/2006, had our 241 meeting today, and one payment has already been deducted from his check. We sent in the first half of one payment before the payroll deduction began. Things have gone smoothly so far but I intend to keep close watch on it.

        I am sorry, I misread your post and I see now that one had already been deducted. Just a clerical error on the payroll depts part, I am sure and I dont think it should be that difficult to fix. I would call my attorney if I were you, and have him/her check on it.

          Things like that can happen with any automatic withdrawal. Some people schedule their bills to be paid automatically from their checking account. It's still up to you to make sure the money is taken out. It can be frustrating, I know, but it happens. Don't get upset about it and say things you'll regret to your wife's employer or your lawyer. Mistakes happen.

              In our case, the attorney submitted a wage order through the court sytem
              which went to my payroll department.
