    Car payment not being made?

    Ok, we filed on 4/1 and my car payment was supposed to be paid outside of the plan.

    Since we filed the Credit Union hasn't taken any of the payments out of my account. Do I need to contact the Credit Union or my Attorney? I emailed my attorney, but haven't heard back from him yet. I don't want my car to get reposessed when the money is sitting in the account!

    call the credit union and ask - probably whats happened is they dont want to take the $ out in fear of violations (yes even though you "technically" didnt include them - you actually did include them in your BK). FWIW, if this is VACU - they wont even mail you a statement on your car account unless you put it in writing that communications should continue (we have VACU and didnt include our car in our plan either...so thats why I know).

      Thanks, I didn't know if I could call them direct or go through my attorney.

      Catch may be that the loan is in my name and my ex-husband (he is the primary). I have since divorced and remarried, but it was easier to leave ex on the loan then try to refinance. Our divorce decree clearly states that I am liable for the car though. Will this make a difference? My attorney knew all of this and said it was not a problem.

        do you have authorization to discuss the account? If not - they wont talk to you. To remedy this, call ex and ask him to add you as authorized to discuss / make changes / requests to the account.

          We are both on the loan and CU account (not VACU) and I can take money out of the CU account without his consent, so I would guess I am authorized.

          The loan is through the CU and we have a savings account with the CU just for the loan payments. $ is automatically taken out of my check each pay period and transferred to the CU savings account. The CU then automatically withdrawals the Loan payment at the end of each month.

          I will try calling them later this afternoon and see what they say.

            The majority of companies stop all automatic payments when you file. You probably need to make the payment manually from now on.
            I use to have an auto withdraw for my HELOC, and had to set up an automatic transfer using the website transfer funds options to pay it now instead.
