I finally met with attorney yesterday. It was a big relief just gettin that done!
He made it seem very simple, i was hoping from some more assurance everyone here as to if it is really so...
I am concerned about potentially losing my job during the repayment process. He says not a big deal - we just go in front of the judge plead hardship and get it discharged.
Is it really that simple? don't they have to convert it to a ch.7?
I am concerned about a Dental Bill. Turns out i needed 3 crowns. I thought i only needed one but when i got in the chair he said i needed 3 and they were all in a row so it's best to do them together. I paid $875 that day, my insurance maxed out at $1000 and did not cover the rest - He still wanted another $950. I did not have the money so made a payment plan. He was not happy stating they are not a financial instution, but more or less stuck as teh work was done.
I paid the $875 via Credit card around the middle of April. If i File BK would they not cosndier that fraud as i am clearly under financial diress? Attorny said the fees sound excessive and he would not pay if he were me. Instead use those funds to pay him.
Lastly, I thought for sure i needed a Ch. 13 i wanted to lien strip the 2nd Mtg as well as eliminate CC debt. Although i am above the median for Fl. by a few grand he said becuase of contributions i have made to help my mother i should qualify for a Ch.7 - and if he were me that's what he would do.
I realize that i can re-affrim my 1st Mtg and keep the house so long as i continue to pay. I am concerned about leaving the 2nd hanging out there. He thinks there is too much negative equity and i should walk away and just get a clean slate from all debt.
The guy seemed really nice overall. It's just hard to know for sure if he really knows what he is talking about. I am naturally skeptical. Obvious answer is to talk with more attorneys - But i did like this guy personality wise - he was also very non judging - which i neeed as i already feel bad enough being in this mess.
