    Funny hoa bill

    Guys, I say funny, because I HATE my HOA - and that goes back 14 years, far far far before the BK! Anyway...they print a bill on May 5th - there is NO way even by snail mail they would not have gotten the filing notice - just $500 or so - 2 quarters of HOA fee - BUT mailed on May 10th!

    I'm seeing atty next week, I think I'll bring it with me...maybe he'll decide since they mailed it on May 10th it's worth a few pennies! Sorry guys, small small issue, but the HOA is next to useless and their fees keep going up and up and up...

    I think you can probably chalk this one up to "it crossed in the mail" scenarios because thats what you're going to hear when the HOA is asked :/ FWIW, getting awarded damages for stay violations takes a very very long time and alot of repeated attempts for collection. Trust me - we're about to go to court over violations that spanned over 9 months from our filing date, with repeated attempts to collect (minimum of 7); we were supposed to go a few weeks ago but it got moved due to judge not being there. Whether we receive any $ or not is up to the judge at this juncture, and while the $ would be nice (not to mention we could use it ) we're really not sure if we'll get awarded anything or if they'll just get a slap on the wrist - time will tell. However since you've mentioned suing for violations, be sure to check the contract agreement you signed with your lawyer as many times anything above your 13 case is in addition to the fees you paid (most will require an AP to sue). We got lucky, our lawyer does them as all inclusive to his fee, and if awarded any monies, we split it 50/50.

    Just be sure to keep everything you receive from here on out and provide a copy to your lawyer every time it occurs. Your lawyer should, at this point, issue a written letter stating that you've filed BK, they received notice on XXX day, and any further attempts at billing will/could result in potential AP.
