I filed Ch 13 bankruptcy in March 2007. My only secured debt was a 2003 Nissan which had been financed with USAA. I elected to keep the vehicle and was required to pay $300 monthly. Fast forward to September 2010. The vehicle now had 120k+ miles on it and I decided that my $300 a month would be better off going towards a new vehicle. The trustee approved my request to purchase a new vehicle and I did in October 2010. I contacted my attorney who then filed all necessary paperwork with the courts for the surrender of the vehicle. USAA did not object and the judge approved the request to surrender. With the vehicle being surrendered, my plan was now complete and my BK was discharged Feb 2011. It is now almost May and I have not heard a word from USAA regarding picking up the vehicle. I am fairly ambivalent as to whether they come pick it up. However, how should I proceed seeing as it has now been close to 6 months since I opted to surrender the vehicle?

If you want it out of your garage (or driveway) and don't want to keep it insured & titled, then just give them a call and ask them where they would like it turned in...Filed Chapter 13 02/2006 - Confirmed 05/2006 - Discharged 09/2011
