    Foreclosure and Chapter 13, now how long before I can purchase a house again?

    First off I searched and found a similar thread but it dealt with chp 7, not chp 13. Ok so I filed chapter 13 BK in last month. I also lost my house to forclosure in Jan. of 2010. I'm looking at a 60 month chp 13 payment plan if the trustee and judge approve.

    My question is how long would it take for me to get a home loan with the BK and forclosure on my record?
    (My attorney told me it would take about 3 years, from the file date, at the minimum and my steady employment would help.)

    Also I'd assume that a large down payment (20%) and high interest rate will be what I'd be looking at , correct?

    You may qualify with FHA guidelines to purchase after 3 years in, but it will be difficult to find a lender that will do so. Your interest rate would probably be lower if you wait until you are done with your Chapter 13 plan.

      3 years from foreclosure. HOWEVER, it will be very difficult for you to get approved during an active 13, and not just for lending, but you have to get the chapter 13 trustee to sign off and approve it the purchase, at which point you may need to explain where you got the money for the down payment if all your disposable income is going into the plan.

      So, is it possible purchase during a chapter 13, yes....is it likely, not really, so many hurdles and many sellers and lenders aren't going to bother with it.
