Confused about status of claims report

    Thank you very much Pandora!!! One more question if I may - re 13dataCenter - will I see anything there before confirmation and/or first payment?

    Also, our first payment is due about a week after 341 meeting. I was planning on (for the first payment) to overnight it to the Trustee PO box via USPS express mail, but that's two days before 341 meeting (I have to wait until I get paid...) - so is it ok to send it to PO box (keep copy of money order, mailing receipt, and printout from USPS website that it got there - to show Trustee that payment's been made) or is it better to take payment to 341? I guess once we get 341 notice in mail (NO way am I telling atty that I got a PACER acct) I'll ask atty whether to mail or take? I know some of them don't like to be given a check as they have to send it to their lockbox anyway...?

    Yep - what HHM said . 13data is more of an accounting tool for you to keep track of payments made by the trustee more than anything else.

    As to the student loans - yes I do believe it goes back to whatever your payment was before. If I'm not right on that account, someone will correct me I'm sure.

      With 13Data, it basically is just a bookkeeping record for the trustee (of sorts) and a method/means for you to keep track of what's been received, paid out, and when. The only other thing that will show on 13Data is when you are confirmed - it will update as confirmed (at least ours did & reflects it).

      As to the second part of your question - the payments go to a PO Box, which then get accounted for, and info forwarded to Trustee (thats how ours works anyway, goes to a POB in TN). If you overnight it the day before its due, there is no guarantee that it will be signed for at that point since many only pick up once a day. The Postman will leave a notice if you do sig. confirm. and whomever picks up the POB will have to go to the post office. Many trustees will not take payment at the 341 as it states your 1st payment is due 30 days from the date of filing, and most 341's are 45 days or so from filing date. Its best to call your attorney and ask if it'd be alright to do it the way you plan or they may tell you to call and talk to the trustee's office (assistants) who can tell you. Make sure you know what payments your trustee accepts prior to sending them out - many do not accept personal checks.

      PACER account isnt an issue - why do you think it is? It only becomes a problem if you go over $10 in a certain period of time to which you will be billed. Make it a habit to only check PACER once a week, usually on Fridays - as thats when everything for the week will be in. I've been with PACER since we filed last March and have yet to get billed for it, but there are some on here that have been checking for updates continually and end up with quite large bills.

      Its always better (IMO) to mail the payment at least 10 days before its due as we've found it takes, on average, that long for it to credit to our account (and thats business days, not weekends). You dont want to be late paying your trustee and the best way to ensure that is to do a direct payment via payroll. Ours is always paid for the following month in the middle of the current month (basically 2 weeks ahead). Our first 2 or 3 payments we paid directly however I still paid it 2 weeks early as payroll deduction is doing.

          Thanks, I see. The total claim amount is a little over $44,000. The only document I have is an order confirming plan. It doesn't have any figures or amounts listed, just states that the ch. 13 is confirmed. Your input is very helpful, this process can be a bit confusing. I'm just trying to figure if we a getting close to the end, or should I just keep my head down and hands to the plow.

            What you want to look at it is the Chapter 13 plan that was confirmed. Most chapter 13 plans go through a couple rounds of modification before final confirmation, but the chapter 13 plan will have the numbers.

              I check 13datacenter AND my trustee's site to make sure that my payment was received that month, and that the balances "jive", and... to be nosy about the disbursements made by my trustee. There is a lot of stuff on there that doesn't make sense, like a certain claim listed three times...and I chalk that up to database limitations, or entry errors, and don't worry too much about it. It'll all come out in the wash.

                I took a look at my original paperwork on my vehicles and noticed that one of the cars should be paid off next month. We were never behind or missed a payment. The cars are the only thing being paid in the plan. Will we own this car next month even though there is a balance shown on 13data?

                  It depends on the confirmed terms of your plan. Some bk lawyers stretch the car payments out to be paid over a longer time than the original loan terms to make the monthly payment a bit lower in some situations. Does your Ch 13 plan include anything like this?
