Angelina - our first due date is May 21st for 1st payment. Because of when I get paid, I'm going to send it via USPS EXPRESS MAIL so Trustee's PO Box will have it on May 14th - does that sound ok? I will have receipt of mailing, receipt of...receipt from USPS and copy of money order...sounds good???
It sounds good to me. I kept our paperwork and receipts in a three-ring binder organized by year/month. And I had a pocket in each month, into which I put those receipts and copies.
Good luck!

THANKS!!!!!
Our first post petition mort payment is due on May 1st - website still hasn't been turned off, but I think for the first payment I may fork over $15 and send that express as well tomorrow, and it'll be in their PO box on Thursday...
I didn't, but it would be okay to do so. As long as one of your recipts contains a number that you can track delivery one, you should be okay. Do what YOU are comfortable with

We're up for confirmation tomorrow. Our lawyer's assistant just called, and they're forcing us into payroll deduction. We've made three payments by mail without issue - it's just something the trustee decided and she won't confirm the case if we don't agree. It's going to stir up all the budgeting work I've done for months... the bi-weekly withdrawal will be 55% of one of our checks, or 70% of the others checks, depending on which one of us takes the garnishment.
Wow, thanks for the input. I decided to send it plain old US Mail. I am sending them really early in case one does not arrive but so far so good. It has been received and processed in as little as 4 business days.
There was a discrepancy of less than a dollar between my budget and the amount proposed in my plan that I have been remitting since I filed. I was advised to send a money order for the difference..... less than $5!

The trustee is not the one who confirms the case, the judge is.
Unless payroll deduction is a requirement in your district (I have no knowledge whether that's the case or not) she can object all she wants, your attorney should get the judge to confirm the plan if there are no other objections.
Good luck.
No person in their right mind files a Ch. 13 with lien strip pro se. I have. Therefore, please consider me insane and clinically certifiable when reading my posts, and DO NOT take them as legal advice of any kind.Thank you.
I have had a horrible time with my payroll dept. not sending the payments on time. They claim they send on time but blame the post office. A couple months ago I almost got dismissed because the Trustee hadn't received payment in 3 months! I don't get it, the money gets deducted from my pay bi-weekly. My lawyer said just keep an eye on it through 13datacenter and if you see a payment hasn't been received on time send a payment in yourself! I can't afford to send double payments! Can't I pay the payments to the Trustee myself instead of having it deducted from my pay? I don't have any faith in my payroll dept. and I am tired of worrying about this!
Chapt. 13 Petition Filed 9/29/07

Your attorney should just need to file a motion to vacate the payroll deduction order and stipulate that you shall make the payments directly. Even if your distict normally wants everyone on payroll deduction, you have good cause for wanting to pay directly.
My 13 was originally going to be set up with payroll deduction but I am paid once a month - last working day of the month so that wouldn't have worked. So the trustee agreed to let me send a Money Order or Cashier's Check instead. I've sent a M.O. every month right after I am paid and send it by USPS, certified with electronic proof of delivery. It costs about $4.50/month but it's worth it to know that the trustee's office receives the payment early - then I check with the National Data Center for the trustee's posting. So far, so good.
Pacer says we were confirmed 5/12. Heard nothing from the lawyer (as usual, we have to chase him over everything). Nothing in the mail yet, but it said something about "to be ordered by 6/13".
As for the payroll deduction, the lawyer's assistant said to just keep mailing, and they'd forget to file the payroll deduction paperwork unless they hear from the Trustee about it. I guess it's all handled through the payment center in TN no matter how its paid, so as long as it's there the account gets credited.
The problem is our payment is about 1/3 of our take home income. There's one pay period where I can save almost all of it at once for the month. If they start taking 26 equal payments out of one of our paychecks, it's gonna screw up four months worth of adjusting to the new budget. I explained this, lawyer said they don't care - not our choice.
Thanks so much for!!!!! All the best to you!!!!!!!!!!! Sounds like they may not "care" since the $$ gets there. Yes, the PO Boxes for all the 13 trustees seem to be in Memphis, and SunTrust runs their lockbox for them. (Long story - Express mailed 1st payment for spouse's 13 - USPS sent it to St. Louis - three heart attacks later, it arrives at PO Box yesterday - about 5 days before due date!!!!
Spouse was told (341 seemed to have gone well...) that for those folks whose check isn't covering in full and/or get paid irregularly that lawyer has to put in motion to get ability to continue to mail...
Our confirmation is in about a month...still waiting for other shoes to start dropping....
