    Temp Job Income and TRCC

    Hello,

    This is my first post, but I have read BK Forum for a year, some great information here.

    I havea question that I can't find using searches and I hope someone can help.

    Long story short, chapter 13 our original payment was 1600.00 monthly payment for my wife and I. This was pre-confirmation. To get confirmation, my lawyers said trustee wanted more money, and were going to ask for more at TRCC. Well they planned to increase it to 2750.00!!! Which seems utterly outrageous to me becuase that amount over the next 4 years would easily overpay our total owed. WE have been paying for one year so far.

    My wife then lost her job which is about 35K/yr. I make 106K/yr, we have four kids and chapter 13. Our lawyers put in a temporary injunction with the Trustee and lowered our payment to 750 per month, until TRCC (not sure why it is sooooo late).

    We are still to the bone on finances (but haven't used a CC in over a year, how nice!). We have so little money that my wife has considered trying to do some temp work with a temp agency.

    My question is - does anyone know if her temp work (if she gets any) would affect our chapter 13 payment?

    Welcome. In short - any additional income will count (or should) in a Ch. 13. If your plan is set to be at 100% paid back, then you need to find out what percent is secured & unsecured, and see if you can play with the numbers. Are you keeping items that have equity in them (ie, paid for vehicles)? Do you owe back taxes? For your plan to increase over $1K as it did...you're keeping something or you have secured priority debts that must be paid.

    It sounds like your plan has very little wiggle room, but remember that a CH. 13 isnt meant to be punitive; if it is, then you have to take a hard look at everything and see what may need to be turned in to the trustee or cut back on.
