    Chapter 13 limits

    I am hoping one of the experts here can give me a final answer.

    What is the ch 13 limit for 2011? I've seen the $360K figure, BUT on one atty's site in CA it's $365K...anyone know for sure?

    Also - is there any way to EXCLUDE a fed gov't student loan in deferment from unsecured Ch 13 limit? That may mean things are very...tight....not quite there but...tight...

    It went up by about 7%, so it is a "little" higher
    I believe the exact 2011 numbers are
    Unsecured 360,525 (they were $336K)
    Secured, 1,081,500

    Also, no way to exclude a debt from the debt limit issue.

      Thanks! I figured - then it's going to be separate and staggered 13's or a 13 and a 7...like I said, I've learned not to fear the 13!!

      (But, i wonder why this lawyer in CA has 365K- if that's a typo it's a pretty big typo!)

        HHM I guess I still have then the following question:

        IF my total unsecured (EXCLUDING STUDENT LOANS AND IRS) DIVIDED by 60 is LESS THAN the DMI, would my payment be the DMI OR DEBT/60?

        AND if I may - say the Means Test shows that I need to be in Ch 13 (which I think so) - it shows say $1,000/month in DMI - NOW, since some of my former P/T jobs have/will stop by May, per Lanning, can the atty when preparing the budget argue that Part Time job A and B are no longer there, hence we can't count it towards paying into CH 13? In other words, say (as I wrote above) DMI is $1,000 - then you subtract Part Time job A and B which are gone/going away, leaving, say $500/mo DMI - could the atty argue for the $500 because that is forward looking??

        Sorry for the million and one questions - want to be prepared for next meeting with atty!
