    Motion to dismiss changes

    Im still waiting to hear from our attorneys about the 3 secured debits that were higher than claimed in our plan.

    I did the math and it came out to be about $3200.00. I assume the ammendment will spread that over the remaining 36 months.

    will i have to pay any ammendment fee's to my attorney, they havent said anything yet.

    We have two weeks left to file an ammendment and im getting anxious!!!!

    I know you're anxious, but these wheels turn slowly. It is always hardest on us doing the waiting. It's only been 6 days since you received the letter about your plan not being adequate, so your attorney probably has jumped all over it yet. (You are also pre-341 meeting correct?) Your attorney will amend your plan, and if he/she charges more to do it that will be taken out of your plan typically. (You shouldn't have to pay anything out of pocket for it unless your agreement with your attorney states otherwise.) Hang in there, these things do take time.

      Hey newbie thanks for the support. My worries come from the 1st atty we hired totally screwed us over so much we had to hire this atty to bail us out of losing our home after we were in our chapter 13 plan. He gave us completely incorrect information and the morgage company filed a motion to dismiss and never told us. So they went to court got the order passed to forclose. This atty came in and saved us but there was a stipulation that if our case was ever dismissed..the bank can come right in and take our home( Thats another story). We did get out $$ back from the original atty too.


      I appreciate you confirming it will take come time. Our atty did say he will need like 2 weeks to get everything straightened out and he will call us before he files anything. I just want it over with. I have paid every payment on time never late nothing. So its like i didnt do anything wrong and im getting punished..lol

      Were two years into the plan so we already had the 3-4-1 meeting....thats the even stranger part the plan was confirmed back in 2009
