    Two questions in a 13

    1. I am trying to sell my home since I have moved to another state. The roof has a leak and this is affecting the ability to sell. I am slated to receive a $4000+ tax return. Could I request to keep the entire return to put a new roof on the house and is this likely to be approved?

    2. One+ years into 13 and in serious relationship. According to the Trustwin website, my base payment amount is $57540 but my claims total $46142. I understand that marriage could increase my disposable income which could raise my payment amount but wouldn't that just shorten the length of my 13?

    Thank you for the help!

    1) If you are not living in the home and not keeping it then I doubt the trustee would allow you to keep the refund to repair the home. (Doesn't seem like it would fly, but it wouldn't hurt to ask. What advantage to YOU is there in doing this???)

    2) Any income that your new wife contributes to the household would be considered part of your income and could go to the unsecured creditors. Talk to your attorney before you get married about the ramifications.

I'm not an attorney. My replies are merely suggestions or observations, not legal advice. As always, consult with an attorney before making any decisions.
