We filed for Ch 13 in the beginning of December and we were confirmed about a month ago. Our confirmation letter says that we have to surrender all tax refunds and I am planning to do that. We are getting a very large refund from both the feds and the state this year, but I corrected the withholding a couple of months before I filed so that won't happen next year. I saw that Justbroke posted on another thread that they usually don't keep the refund on the year you filed. Is that true? Our trustee sent us a letter last week reminding us that we have to send him our tax return and refund.

This year we got the largest 'refund' ever, due to overwithholding. Sad to see it go, it's about 10% of what we owe to non-secureds, so we're still getting off lightly. But of course we could surely use it. My lawyers office hasn't said how we send it in. I just photocopied the state refund check and got one cashiers check with our regular payment and the refund all in one to send out. Not sure if/when we are to provide the actual copy of the returns. We are not even confirmed due to paralegal errors.
