    Scared and Stressed used credit card after filing....

    Hello Everyone,

    I have a question that has been bothering me since I filed on 03-09-2011. This process has been very gruiling and stressful. I am a mother of two and my husband just lost his job. After strugling for many months I have decided to file chapter 13. I had one credit card limit at $250.00 with a $0 balance at the time of filing. I went to the casino on
    03-11-2011 which turned out to be the wrong thing to do and did 2 cash advance one for $150.00 and one for $60.00 with the total of fee's being $24.00. Now I'm afraid that my bk will be discharged. This was a really stressful not thought out mistake. Is there any thing I can do? 341 meeting 04-20-11

    Since the debt was incurred *after* you filed, I am pretty sure you are 100% responsible for it.

    Make sure you tell your attorney what you did.

    I would try to make sure it is paid in full before your 341 if at all possible - if you can't pay it in full I would try to make sure you make your payment before the due date - you are close to your credit limit so be careful that any monthly fees or finance charges don't push you over and penalize you even more.

      I have payed it back already should I also close it? My attorney had only told me to have it a 0 balance on the filing date. I didn't know I wasn't suppose to use it until I received a notice Wednesday from my attorney saying no neww debt. I had the card for over 2 years. Thanks for your quick response I appreciate it.

        getatyungsta, once you file you are not allowed to incur any new debt without the trustees permission. You should cut up the card and any other cards you have. You need to budget to live on cash only. Once the credit card company finds out you filed they will probably cancel the card even with a $0 balance. Very few credit cards survive. I have a Macy's card that is still open, but I would not use it. good luck

            Did you have any luck at the casino?
            Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

              Of course not OhioFiler it was a temporary high to get my mind off things. I was smart enough not to take a lot of money there I had only took 80 bucks, and when it was gone remembered I had my credit card with me. The next day I sent them a money order just worried that it may come up in the trustee heering 04-20-2011. Learned a good lesson to never try to turn money into more money when you don't have none to begin with....
