Received our Discharge but trustee says case is not to be closed for up to 150 days

    Received our Discharge but trustee says case is not to be closed for up to 150 days

    What does this mean we received our discharge ordered by the judge listed on pacer
    but the trusee sent a letter asking the case remain open for up to 150 days allowing his office to finish their end.
    Am I able to go get certified copies of the discharge and creditors discharged in the bankruptcy with this like this?
    Any help would be greatly appreciated.

    Pretty normal stuff I think. The discharge isn't affected by the closing date. The trustee has to be sure he accounted for every cent you paid in your plan, make sure he's crossed all his t's and dotted all his i's. You should have no problem getting copies of the discharge.

      do you know is there a time frame since we got a digital copy from the attorney just a few days ago that we have to wait to go to the court house to get certified copies of the discharge and all the bankrupcty papers like the petition and the schedule of discharged creditors?

        So far as I can see, this is not abnormal. You can simply print "uncertified" copies of your discharge and that would do for you.

        In this day and age, this person is probably up to his neck in work.

          thanks but i need certified copies for the mortgage company of all my bankruptcy papers non certified wont work for them since the digital one is not signed by the judge and i need all the other papers to like the discharged creditor list

            I would think you could go now. The attorney couldn't get a digital copy if there wasn't the actual discharge on file. Give the clerk at the bk court a call and ask what it will take for you to get the certified copies.

              A couple of threads ago you were advised to call your trustees clerk to ask if you could pick up signed / certified copies. Did they tell you that you couldn't do that?

                  It sounds like they won't give certified copies until everything is closed. Wish there was better news for you.

                    I meant the trustees office doesnt do that he said we had to get them from the court did not mean he said they dont do it

                      A discharge order is a court document. Only the court can certify a copy of a court document.

                        If you want a certified copy, you must ask the Clerk of the Court. My District charges $9.00 to "certify" a document. They will stamp it with the Court's seal.

                        So just contact your Clerk of the Court! This is normally done by the Intake counter in the Clerk's Office.
