    Trying to get things together to file and Questions

    I have been gathering information left and right to be able to take to the lawyer when we file.

    I have credit report from November and bill statements, some of them have gone to collections and I don't have the name address and total amount due on some of them. Does this matter? How do I go about getting the correct and most up to date information?

    Also, DH switched jobs in January, how does that affect the 6 months pay, since the pay rate is different from one job to the next. Will they just take his current paystubs and assume that's what it will be in the next 4 months as well?

    Any other advice before we file?

    When you decide to hire a lawyer, he/she will pull your credit reports, so you needn't worry about that. As to the name / address of creditors - just keep all the statements you have for each account and be sure to include them in the claims. Usually your credit report has addresses for the companies listed on it, but if accounts went to collections/junk debt buyers, they may not be listed on the reports, so make sure to include any notices you received from them as well.

    As to hubby switching jobs - they will go off of the previous 6 months before you file, so since his income is lower now, your lawyer may tell you to wait to file in order to bring the 6 month period to an accurate number (over median / under median). Your trustee may postpone your confirmation hearing until he/she see's a certain amount of current paystubs from hubby, but thats not a big deal either, just par for the course when you switch jobs.

      I think that they may be able to use the Lanning Decision... this is a look forward instead of a look back... My Lawyer used it..(although I had to educate her!).. I took a $10,000.00 paycut about a week after filing....
