Letter of Motion to keep federal tax refund.

I have a tax refund due from the Federal but own the State half of my federal tax refund. Also, my car broke down and the repair cost me almost exactly the remaining federal tax refund after paying the state tax due. My attorney told me that a new law was in place for 2011. I am required to write a letter of motion to my trustee asking them and my creditors permission to use my federal tax refund to pay for the State tax due and the repair of the car. After paying for both I only have $10.00 left to send to the trustee.

Does anyone have an ideal where can I find a sample letter showing me how to write to the trustee a motion letter requesting to keep the full tax refund? Also, do I even have a change to get this approved? Thanks!
