I am surrendering house in 13 that has tenants. I am going to be sure to work with atty to set aside their deposit or pay it back before filing. I don't want to cause them any problems as they have been great tenants. My atty said they should make out well with some months free rent until the house is foreclosed. My worst fear is my mortgage co contacts them before this becomes public info but my atty assures me mortgage company wont send anything to the tenant's home address. Also should file in a month or so and am two months behind on mortgage (which we stopped). Hopefully it takes a while for Ally to start foreclosure.
