    Injured Spouse Form

    We are currently in the in a Chapter 13? Part of the repayment plan is child support that is in arrears. Do I still need to file the injured spouse form?

    From what I can tell, that is an IRS form to prevent the garnishing of your tax refund for a spouses child support payment. If the child support is being paid through your plan, I don't think they can garnish your tax refund for it. That would be a violation of the automatic stay.

      Child support took the taxes. Even though we are in plan and they have been receiving payments. Our attorney stated that was not usually the case. I will be filing an injured spouse form today.

        I used to file injured spouse due to backpay that my husband had to another state. I was entitled to half of the refund....
