    Notice of Docket Entry HELP what is this

    Just recieved a Notion of Docket Entry
    States that Trustee cannot recommend confirmation of plan at this time as plan does not treat prepetition arrears claim of Chase.
    Case set for status conference on Feb 9, 2011

    What is this and do I have to go to conference or let attorney handle this

    It sounds like you have a mortgage with Chase, you were late on mortgage payments and your plan doesn't provide for the amount that was overdue at the time you filed (called "arrears"). Your mortage arrears needs to be included in your plan payment. Your plan needs to be amended to do that.

    You probably will not need to go to the status conference. But, call your attorney and ask. In fact, it is possible it will be removed from the court's calendar if your attorney gets the plan modified to the trustee's satisfaction and the trustee recommends confirmation before Feb 9.

      Yes I have a mortage from Chase, but have never been late on a payment, until we filed.
      Guess its a paper work thing
