Why do some Trustee's allow people to keep their tax refunds and others don't?

    Some trustees have written instructions to their filers, some post information for their filers online, and some trustees provide no information to their filers at all.

    When in doubt, always ask your lawyer. Never assume that something a member posts here in the forums is what your trustee will expect you to do too.

    06/28/06 - 341 Meeting
    07/18/06 - Confirmation Hearing - not confirmed, 3 objections
    10/05/06 - Hearing to resolve 2 trustee objections
    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      I have heard that they can actually go through the IRS, but our trustee just made us sign a directive stating that we will send him our unsigned refund check as soon as we receive it.
      Filed pro se, made it through the 341, discharged, Closed!!!

        At the beginning my atty told me that I wouldn't get my refunds but I haven't seen it written anywhere, nor has the trustee said anything. After calling state and federal irs', they too told me that I should get my refund since all of my back taxes are included in Chap 13 and proofs of claims have been sent it. I've heard it also depends on your jurisdiction as well. I've looked through all of my filing docs and re read the book I got at my 341 from my trustee...nothing. So I think my atty assumed since I owed back taxes, I wouldn't get it?
