    Can You Get 1ST Mortgage Modified After Confirmation

    Has anyone ever been able to get a Loan Modification after your Chapter 13 has been confirmed? Or is this even a good idea?
    We tried while in BK before confirmation and the mortgage company offered to bring us current and increase our payments by $80 per month for the next 5 years to make up arrears but the Trustee said we would need to pay $10,000 more to unsecured creditors so it seemed like we would be paying the amount 2X.
    If we did get a modification would the Trustee just want the difference?

    I would also like to know the answer to this. I called Wells Fargo and they basically said they couldn't talk to me because I filed BK. I believe the rep said they needed my lawyers permission to talk to me. I would love to do a mortgage mod now since I was confirmed in Dec.

      This can be done, but as eluded to, it does require permission so that the Bank does not violate the automatic stay. While I did mine after Confirmation, I did it after conversion to Chapter 7 and before discharge. I had to complete some forms authorizing the bank to talk to me about the modification options.

      If you do receive a modification, be aware that any difference in the old payment and the new payment, may need to be paid to the unsecured creditors, so you'd probably see no benefit as far as plan payments are concerned. However, once your case is discharged, you may be better off by having a better rate or a newly amortized payment over a new term.
