HI, Im getting married sometime next yr (2011) whats happens now with my BK payments do i have to call the lawyer and start again? do i have to add my wifes income ?
It would be a good idea to consult with your BK attorney on this situation. Any significant change in income and/or expenses is relevant in a Chapter 13, no matter what the circumstances.
Typically once someone who filed a single Ch 13 marries during a confirmed plan, the plan has to be amended to include your wife's income that she is regularly contributing towards the household.
Don't wait - call your lawyer and set up an appointment now so he/she knows about the pending marriage and the two of you can discuss what will happen to your plan after your marriage. Congratulations on your upcoming nuptials!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
